The University of Wisconsin-Green Bay supports a safe and inclusive environment that enhances academic pursuits and student success. A Medical Amnesty Policy benefits the campus community by encouraging students to make responsible decisions in seeking emergency medical attention in serious or life-threatening situations, including those which involve alcohol and/or other drug use or abuse. This policy seeks to diminish fear of disciplinary and conduct sanctions in such situations and to encourage individuals to seek needed medical attention immediately for students in distress from alcohol and/or drug use. These guidelines apply only to disciplinary actions related to the caller and the individual in need of medical attention. They do not apply to the supplying of alcohol, use or possession of other drugs illegally, or other crimes committed while under the influence, and they may not apply to students involved in repeated violations of university alcohol or drug policies.
Guiding Practices
Victims of Crime
As required by State Law, in cases where a student has been a victim of sexual assault and/or a violent crime while under the influence of alcohol, the Dean of Students, Housing & Residential Education, and UW-Green Bay University Police will not pursue disciplinary actions against the student victim for his or her improper use of alcohol (e.g., underage drinking). A student victim who is under the influence of alcohol at the time of a sexual assault and/or a violent crime is strongly encouraged to utilize university and community assistance.
Person in Need of Medical Attention as a Result of Intoxication or Overdose
When a student requires emergency evaluation and/or treatment at a medical facility for an overdose of alcohol or drugs, the student may be required to complete an alcohol assessment and/or education program as a part of the University's health and safety response. A parent/guardian may also be contacted when a student is transported to an emergency room for overdoses or severe intoxication.
Caller
When a student calls on behalf of an individual who requires emergency medical evaluation, the caller will not be subject to disciplinary actions (disciplinary probation, suspension, etc.) under the Student Code of Conduct nor Housing & Residential Education for the personal consumption of alcohol (e.g., underage drinking), if the following conditions are met:
- The caller must remain with the impaired individual until assistance arrives.
- The caller must fully cooperate with emergency responders and;
- The caller must complete any education programs and/or assessment assigned by the Dean of Students Office and/or Housing & Residential Education.
UW-Green Bay University Police typically decline to cite a student for his or her personal consumption of alcohol (e.g. underage drinking) if these conditions are met.
